Welcome to Literaturapps! These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and other services (collectively, the "Services") provided by Literaturapps ("we," "us," or "our").

Please read these Terms carefully before using our Services. By downloading, installing, accessing, or using any of our applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use our Services.

1. Eligibility and User Agreement

1.1 Age Requirements

You must be at least 13 years old to use our Services (or 16 years old if you reside in the European Economic Area or United Kingdom). If you are under the age of majority in your jurisdiction (typically 18 years old), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1.2 Agreement to Terms

By using the Services, you represent and warrant that you have the legal capacity to enter into a binding contract and that you will comply with all applicable local, national, and international laws and regulations.

2. Description of Services & Local Architecture

2.1 Services Provided

Literaturapps develops educational and literary mobile applications designed to democratize knowledge globally. Our products include study guides, interactive anatomical atlases, quizzes, gamified learning modules, and digitized public domain literary classics enhanced with modern reading tools.

2.2 Local-First Storage Architecture

To protect your privacy and ensure seamless offline usability, our applications are designed using a "local-first" architecture:

  • Reading Notes, Bookmarks, and Settings: Any text notes you write, bookmarks you place, and customization settings you adjust are stored locally on your device.
  • Quiz Progress, Scores, and Ranks: Your quiz high scores, ranks, levels, and achievements are calculated and saved directly in your device’s local database (SQLite/Shared Preferences).
  • No Central Account Required: Literaturapps does not require or offer central account creation on its servers. We do not transmit or store your usernames, custom avatars, or reading notes on our servers.

⚠️ Risk of Data Loss: Because your data is stored strictly on your device, uninstalling the application or clearing its cache will permanently delete your notes, reading progress, high scores, and custom settings. Literaturapps cannot recover or restore this data.

3. Intellectual Property Rights

3.1 Proprietary Content

All materials, including but not limited to software code, design systems, visual interfaces, graphics, logos, premium study questions, rank descriptions, quiz algorithms, achievements, trademarks, and compiled educational materials (collectively, "Proprietary Content") are owned by or licensed to Literaturapps and are protected by intellectual property laws.

3.2 Public Domain Classics & Enhancements

Certain applications in our portfolio display public domain literary classics. While the original underlying texts are free of copyright constraints, the proprietary software, formatting, interactive features, study tools, custom annotations, audio narrations, translations, and illustrations added by Literaturapps remain our exclusive intellectual property.

3.3 User-Generated Content (Notes)

You retain all ownership rights to any reading notes, comments, or texts you write while using our Services. By writing notes, you acknowledge that they are stored locally on your device. Since Literaturapps does not access, copy, or host your local notes, you are solely responsible for backing up your device content.

3.4 Limited License

Subject to your compliance with these Terms, Literaturapps grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install a copy of our applications on a mobile device that you own or control, and to run such copy solely for your personal, non-commercial educational and entertainment purposes.

4. In-App Purchases, Subscriptions, and Billing

4.1 Upgrades and PRO Access

We may offer certain premium features, modules, or ad-free experiences (such as "Anatomy Book PRO" or similar premium tiers) for purchase within our applications. Premium access may be offered as a one-time lifetime payment ("Lifetime Access") or as an auto-renewable subscription.

4.2 App Store Transaction Processing

All financial transactions, billing, and purchases are processed and managed entirely by the third-party app stores:

  • Apple App Store (for iOS devices)
  • Google Play Store (for Android devices)

By making a purchase, you agree to comply with the terms and conditions of the respective platform. Literaturapps does not collect, access, or store your credit card numbers, billing addresses, or payment details.

4.3 Billing and Auto-Renewable Subscriptions

If you purchase a recurring subscription:

  • Your subscription will automatically renew at the end of each billing cycle unless auto-renew is turned off or you cancel the subscription through your device's App Store settings at least 24 hours before the end of the current period.
  • Pricing is subject to change. If pricing changes, the platform app stores will notify you in advance.

4.4 Entitlement Verification via RevenueCat

We use RevenueCat as a secure, third-party framework to verify your purchase status and unlock your premium entitlements (e.g., ad-free access, unlimited lives, and locked chapters). If your device is offline, entitlements may be verified based on cached credentials.

4.5 Refunds

All refund requests must be directed to and handled by the respective app store platform (Apple or Google). Literaturapps does not have the administrative authority to issue refunds or manage platform billing disputes.

5. Advertisements and Third-Party Links

5.1 Ad-Supported Services

Our standard (non-premium) Services may display advertisements, including banner ads and rewarded video ads (e.g. to unlock premium chapters temporarily, gain extra quiz lives, or double your score).

5.2 Third-Party Ad Networks

We use Unity Ads as our third-party advertising provider. By using the ad-supported version of our applications, you acknowledge and agree that Unity Ads may collect and process device advertising identifiers (such as IDFA on iOS or GAID on Android) to serve, personalize, and analyze ads.

5.3 Disclaimer of Third-Party Ad Content

We do not endorse, screen, or assume responsibility for the content of any advertisements displayed in our Services, nor do we control any products, services, or websites marketed in those ads. Any interaction or transaction you conduct with third-party advertisers is solely between you and the advertiser.

6. Prohibited Activities

When using our Services, you agree not to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the applications.
  • Modify, translate, adapt, or create derivative works of any part of our Services.
  • Exploit the Services for any commercial purpose without our express written consent.
  • Bypass, disable, or circumvent any copy protection, digital rights management, or security features (including ad-blocking or purchase-bypass tools).
  • Use automated scripts, bots, or scrapers to extract content or scores from the Services.
  • Use the Services in any way that violates applicable laws, regulations, or third-party rights.

7. Disclaimers & Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LITERATURAPPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Literaturapps does not warrant that:

  • The Services will function uninterrupted, secure, or available at any particular time or location.
  • Any errors or defects will be corrected.
  • The applications are free of viruses or other harmful components.
  • The educational content, quiz answers, or scientific diagrams are completely free of typographical errors or omissions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LITERATURAPPS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  1. YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES;
  2. ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING ADVERTISEMENTS;
  3. THE LOSS OF USER-GENERATED CONTENT (SUCH AS READING NOTES OR SCORES) DUE TO DEVICE FAILURE, APP UNINSTALLATION, OR CACHE DELETION; AND
  4. ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY.

In no event shall our aggregate liability for all claims related to the Services exceed the total amount paid by you to Literaturapps for the specific application or feature in dispute during the twelve (12) months preceding the claim.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the organization's country of registration, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be resolved exclusively in the competent courts located in the jurisdiction of the organization's registration.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make updates, we will revise the "Last Updated" date at the top of this document. It is your responsibility to review these Terms periodically for any changes. Continued use of our applications following the posting of changes constitutes acceptance of the updated Terms.
